01About Grassara

Grassara provides software tools that assist homeowners and lawn enthusiasts in tracking lawn conditions, recording maintenance activities, monitoring environmental factors, analyzing lawn photos, and receiving automated lawn care insights and recommendations.

Grassara is a decision-support platform designed to assist users in making lawn care decisions. Grassara is not a landscaping company, agronomist, certified turf consultant, irrigation contractor, pest-control provider, environmental consultant, engineering firm, or professional lawn care service.

The Service is intended to provide information and guidance only and does not replace professional judgment or professional services.

02Eligibility

The Service is intended for adults. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use the Service.

The Service is not directed to children under 13, and Grassara does not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information and terminate the associated account.

Grassara may also delete information or terminate accounts if we determine that a user does not meet the eligibility requirements for the Service.

03Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to:

• Provide accurate and current information.
• Keep your account information updated.
• Notify Grassara of any unauthorized account access.
• Use only your own account.

Grassara may suspend or terminate accounts that violate these Terms or applicable laws.

04Subscription Services

Certain features of the Service may require a paid subscription. Subscriptions automatically renew unless canceled through the applicable subscription platform. You can manage or cancel your subscription at any time through your account settings in the applicable app marketplace or payment platform, including Google Play, the Apple App Store, or another applicable subscription provider, subject to that platform's terms.

Billing, payment processing, cancellations, refunds, free trials, promotional offers, renewal notices, and subscription management may be handled by third-party providers, including app marketplaces and payment processors. Unless Grassara expressly states otherwise, those matters are governed by the terms and policies of the applicable app marketplace or payment provider.

Deleting the app from your device does not cancel your subscription and does not necessarily delete your Grassara account. To cancel a subscription, you must follow the cancellation process provided by the applicable app marketplace or payment provider. To request account deletion, follow the process described in our Privacy Policy.

Grassara may modify subscription pricing or features in the future. Any pricing changes will apply prospectively and in accordance with applicable laws and platform requirements. If Grassara later offers subscriptions or services for purchase directly through the website, additional billing terms may be presented at the time of purchase.

05User Content

You may provide content including lawn photos, lawn activity records, property information, zone boundaries and mapping data, notes and observations, soil information, environmental information, and other content submitted through the Service.

You retain ownership of your content. By submitting content, you grant Grassara a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, display, reproduce, modify, and use the content as necessary to operate, provide, maintain, secure, support, and improve the Service.

This license does not give Grassara ownership of your content and is limited to purposes related to operating, providing, securing, improving, and supporting the Service. You represent that you possess all rights necessary to provide such content.

06Automated Recommendations, Artificial Intelligence, and Analysis

Grassara may use automated systems, algorithms, machine learning models, artificial intelligence technologies, user-provided information, weather data, environmental conditions, lawn photos, historical records, and third-party data sources to generate recommendations, forecasts, identifications, analyses, alerts, insights, and other outputs. These outputs are informational estimates only and are intended to assist users in making lawn care decisions.

Lawn conditions vary significantly based on factors including soil conditions, weather patterns, irrigation systems, grass species, pests, disease pressure, maintenance practices, property conditions, product selection, and environmental factors outside Grassara's control. Automated and AI-generated outputs may be inaccurate, incomplete, outdated, unavailable, or inappropriate for a particular lawn, property, climate, or situation.

Grassara does not guarantee:

• The accuracy of recommendations or analyses
• The accuracy of grass, weed, pest, disease, or issue identification
• Lawn health outcomes
• Disease diagnoses
• Treatment effectiveness
• Watering schedules
• Property improvements
• Cost savings
• Prevention of lawn damage or deterioration

Users are solely responsible for evaluating, verifying, and implementing any recommendation, treatment, watering schedule, product application, or lawn care action. Grassara's automated and AI-generated outputs do not constitute professional agronomic, horticultural, landscaping, irrigation, environmental, engineering, legal, or pest-management advice. Users should exercise independent judgment and consult qualified professionals where appropriate.

07No Professional Advice

The Service is provided for informational and educational purposes only. Nothing within the Service constitutes professional agronomic, horticultural, landscaping, irrigation, engineering, environmental, pest-control, legal, financial, or other professional advice. Users remain solely responsible for decisions made based on information provided by the Service.

08Chemicals, Fertilizers, Herbicides, and Treatments

Users are solely responsible for selecting, purchasing, handling, storing, mixing, and applying any lawn care products, including fertilizers, herbicides, pesticides, fungicides, soil amendments, and other treatments. Users must follow all manufacturer instructions, product labels, safety warnings, and legal requirements.

Grassara is not responsible for product misuse, improper application, overapplication, underapplication, property damage, lawn damage, plant damage, environmental damage, personal injury, or regulatory violations.

The Service should not be used for emergency, poison-control, environmental spill, chemical exposure, or safety-response guidance. In an emergency or safety-related situation, contact the appropriate emergency service, poison-control center, product manufacturer, licensed professional, or regulatory authority. Always follow applicable product labels and local regulations.

09Local Watering Rules and Property Restrictions

Users are solely responsible for complying with all applicable watering restrictions, irrigation rules, drought restrictions, utility requirements, homeowner association rules, municipal ordinances, and other property-specific or local requirements.

Grassara may provide watering suggestions, reminders, schedules, forecasts, or estimates, but Grassara does not determine whether watering is legally permitted at a particular time, location, property, or under current local conditions. Before watering, users should verify applicable local restrictions, utility rules, drought notices, watering days, time-of-day limits, and irrigation requirements.

Grassara is not responsible for fines, penalties, violations, property restrictions, water-use charges, or other consequences arising from a user's watering, irrigation, or failure to comply with applicable rules. Users are responsible for ensuring they have permission to access, photograph, map, treat, water, or perform activities on any property they enter, manage, or submit to the Service.

10Weather and Third-Party Data

The Service may rely upon information supplied by third-party providers, including weather, mapping, geolocation, imagery, environmental, subscription, payment, and analytics providers. Such information may be delayed, unavailable, incomplete, inaccurate, interrupted, or subject to outages. Grassara does not guarantee the accuracy, availability, completeness, or reliability of third-party information.

11Acceptable Use

You agree not to:

• Violate any law or regulation.
• Interfere with operation of the Service.
• Attempt unauthorized access to systems or accounts.
• Circumvent security measures.
• Upload malicious software or code.
• Reverse engineer, decompile, or disassemble the Service, except to the extent this restriction is prohibited by applicable law.
• Use the Service to infringe intellectual property rights.
• Scrape, harvest, or extract data without authorization.
• Use the Service in a way that could damage, disable, overburden, or impair Grassara's systems or infrastructure.

12Intellectual Property

The Service and all associated software, technology, content, trademarks, branding, designs, graphics, algorithms, and materials are owned by Grassara or its licensors and are protected by applicable intellectual property laws. No ownership rights are transferred through use of the Service. You may not use Grassara's name, trademarks, branding, logos, or other proprietary materials without prior written permission.

13Feedback

If you provide feedback, suggestions, ideas, comments, bug reports, feature requests, or recommendations about the Service, you agree that Grassara may use them without restriction, obligation, or compensation to you. Grassara may use feedback to improve, modify, market, develop, or operate the Service and related products or services.

14Aggregated and De-Identified Data

Grassara may create, analyze, use, license, share, and commercialize aggregated, anonymized, statistical, and de-identified information derived from use of the Service. Grassara does not currently sell, license, or share aggregated or de-identified datasets with third parties. If this changes, Grassara will update these Terms and the Privacy Policy accordingly.

Such information will not be used to reasonably identify individual users. Grassara will not sell, license, or share aggregated or de-identified datasets in a manner that reasonably identifies you, your household, or your specific property. Grassara retains ownership of aggregated and de-identified datasets generated through operation of the Service.

15Beta, Experimental, and Early-Access Features

Grassara may offer features, tools, recommendations, analyses, integrations, or functionality that are labeled or treated as beta, experimental, preview, early-access, or trial features. These features may be incomplete, inaccurate, unstable, unavailable, changed, limited, or discontinued at any time. Beta, experimental, and early-access features are provided for evaluation and informational purposes only and may not operate as expected. Grassara does not guarantee that beta, experimental, or early-access features will become generally available or remain available in their current form.

You agree to defend, indemnify, and hold harmless Grassara and its owners, officers, employees, contractors, affiliates, successors, and assigns from claims, liabilities, damages, losses, costs, and expenses arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of applicable laws
• Your implementation of lawn care actions, treatments, or recommendations
• Your misuse of fertilizers, herbicides, pesticides, fungicides, soil amendments, or other lawn care products
• Your violation of watering restrictions, drought restrictions, utility rules, homeowner association rules, property restrictions, or other applicable local requirements
• Your access to, photographing, mapping, treating, watering, or performing activities on property without proper authorization

19Termination

Grassara may suspend, restrict, or terminate access to the Service at any time for security, operational, legal, or business reasons. You may stop using the Service at any time and may request account deletion in accordance with our Privacy Policy.

Termination or account deletion does not automatically cancel an active paid subscription unless required by applicable law or handled by the applicable app marketplace or payment provider. You are responsible for canceling any active subscription through the applicable subscription platform.

20Changes to the Service

Grassara may modify, suspend, discontinue, remove, or replace features, functionality, content, or services at any time without liability. Grassara does not guarantee that any particular feature will remain available indefinitely.

21Changes to These Terms

Grassara may update these Terms periodically. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means. Continued use of the Service following publication of updated Terms constitutes acceptance of the revised Terms.

22Privacy

Your use of the Service is also governed by the Grassara Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how Grassara collects, uses, stores, and shares information.

23Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

24Dispute Resolution

Before initiating legal proceedings, you agree to first contact Grassara and attempt to resolve the dispute informally. Any dispute arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cobb County, Georgia, and the parties consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small claims court where permitted by applicable law.
